Criminal Investigation
If a law enforcement agency contacts you or you find out that you are being investigated for a crime listed below, hiring an experienced sex crimes lawyer is not an option, it’s absolutely essential to maintaining your freedom and good name. If we’ve heard it once, we’ve heard it a million times. Police make you feel like they’ll help you out if you cooperate. They tell you if you tell them what happened, they’ll “talk to the judge” to make sure you don’t have to register as a sex offender or predator. Do not believe them and do not talk to them about your case! When you are being investigated, you are a target. The police are not your friends when they suspect you’ve committed a crime, especially one as serious as a sex offense. If they ask to search your home, computer, car, workplace, or email, tell them no. In fact, if they contact you at all tell them you are retaining The Mayberry Law Firm and we’ve advised you to remain silent. Any evidence you give them voluntarily, be it a verbal admission, or tangible evidence found in your home or computer, will be used against you during your prosecution.
Anything voluntarily given to investigating authorities puts you that much further behind the eight ball. Once you make an admission or voluntarily allow the authorities to search your private things, you have compromised part of your case. If any statement needs to be made it will be after you’ve consulted with our firm so that it is done in a controlled fashion and to your benefit.
Conviction
The penalties for a conviction of a sex offense are the most severe penalties available in our criminal system aside from the death penalty for murder. Any plea or conviction carries with it the reality of county jail and likely prison time. If you plea to a crime of this fashion you will have to register either as a sex offender under Florida Statute 943.0435 or a sexual predator under Florida’s Sexual Predator’s Act found in Florida Statue 775.21. Life as you know it will be over. You will be required to stay in constant contact with local law enforcement, notifying them of address changes, phone number changes, email address changes and additions, and will be restricted on where you can live. Possibly the worst stigma of all could be the reality that your neighborhood will know of your sex offender or predator status. You will now bear a scarlet letter. Not every allegation of a sex crime can be helped. For the ones that can, everything you have hangs in the balance. Give yourself the best chance to move beyond these terrible allegations and hire the preeminent criminal attorneys in the Tampa Bay area at The Mayberry Law Firm.
Defense of Your Liberty And Reputation
Every attorney at The Mayberry Law Firm focuses a significant part of their practice to defending the freedom and reputation of our clients facing sex crime allegations. We will interview or depose every material witness driving the allegation against you in addition to interviewing witnesses willing to testify on your behalf. We have private investigators ready to perform background checks on the alleged victim and those in his or her camp. We will leave no stone unturned. We will not stop digging until we know everything about the allegations in addition to the alleged victim’s prior criminal history, any history of untruthfulness, mental health issues, or general reputation as it pertains to the allegations.
Common Sex Offenses
The Florida Legislature forbids numerous acts it considers to be sex crimes. These offenses range from a misdemeanor count of solicitation of prostitution, not requiring sex offender registration to Sexual Battery on a victim under the age of 12, requiring definite registration as a sexual predator. These crimes include but are not limited to:
- Sexual Battery
- Lewd and Lascivious Conduct
- Solicitation of a Minor
- Child Pornography
- Video Voyeurism
- Travelling to Meet a Minor
- Prostitution
- Solicitation of Prostitution
- Failure to Register as a Sex Offender
Though this kind of accusation can shock the conscience, it is not uncommon for an allegation to be completely unfounded. This is common with children who either don’t understand what they’re doing or are lashing out in some way and don’t appreciate the consequences of such a claim. Lastly, in some disgusting situations adults with an ulterior motive encourage their children to make such a claim. If you are the victim of a frivolous sex crime allegation, immediately contact The Mayberry Law Firm at 813-444-7435.
