First Degree Murder
First degree murder is the most serious homicide crime, and a conviction can result in the death penalty, depending upon the circumstances. First degree murder constitutes the unlawful and premeditated killing of a human being. Put more simply, if there was a plan to kill another person that was not borne out of an enraged, depraved mind, then this classification of murder is applicable.
Premeditation can be formed in an instant, and courts often find that the premeditation element can be met when there are mere moments of planning. Capital first degree murder can also be charged if there is an unlawful killing of a human being by a person who is engaged in the commission of a serious felony.
Second Degree Murder
Second degree murder is defined as the unlawful killing of a human being, resulting from an act imminently dangerous to another, committed with a depraved mind, and without premeditation to end the life of another. Second degree murder is a first degree life felony which is punishable by life imprisonment and a $15,000 fine. Notably, it’s also considered second degree murder when someone is during the commission of certain felonies, such as:
- Arson
- Aggravated stalking
- Burglary
- Carjacking
- Drug Trafficking
- Home-invasion robbery
- Kidnapping
- Robbery
- Sexual battery
Third Degree Murder
Third degree murder is the least serious degree of murder and is punishable as a second degree felony. Third degree murder involves the unlawful killing of a human being, when committed without an intent to result in death, by a person engaged in the commission of, or in the attempt to perpetrate, any felony other than those listed above.
